Every client thus confronts the challenges that arise when regulatory forces mix with market dynamics. To guide clients in that state of affairs, we work from two distinct vantage points.
- One focus is the real-world effect the legal matter will have on a client's business objectives and performance. This requires our having not only substantive knowledge of the client's enterprise and industry, but also the business judgment without which such knowledge would not be particularly valuable. We view this sophistication as sufficiently critical that WMN limits its engagements to those for which the lead attorney has had actual client-side experience as a principal, in-house advisor, or senior officer.
- In tandem, our second focus is the combination of factors that establish a client's 'perceptual equity' – how the client's cause must be perceived and assessed by regulators in order to achieve the outcome sought – and in that light, to craft the appropriate legal strategy. This task is multifaceted. The complex character of agency decision-making demands not merely an understanding of the applicable regulations, but strong relationships with decision-making personnel, a keen sense of the varied institutional forces that affect the given case, the ability to create a record with compelling empirical support, and an analytical framework that connects all the dots.
